Adidas Sues Ecco Over Trademark Infringement

Adidas is heading to court once again to defend its Three-Stripe Mark.

On Wednesday, Adidas America Inc. and parent company Adidas AG filed a lawsuit against Ecco USA Inc. and Ecco SKO A/S. The suit, filed in the U.S. District Court of Oregon, claims that Ecco has infringed against Adidas’ decades-old trademark by “offering for sale and selling footwear featuring three and four parallel stripes on the side of the shoe.”

In its filing, Adidas goes on to say that the stripes on Ecco’s shoes are likely to mislead the public about the source of the products and confuse consumers. “Ecco’s actions are irreparably harming Adidas’ brand and its extremely valuable Three-Stripe Mark,” the suit reads.

Ecco has not responded to a request for comment.

Citing the Trademark Act of 1946, Adidas is asking the court to “preliminarily and permanently” prevent Ecco from selling shoes with misleading stripes and to turn over all profits from the sale of the footwear. It also is requesting both monetary and punitive damages.

The Adidas legal team has been busy so far this year. In February, the firm won a preliminary injunction against Skechers USA Inc., prohibiting that company from selling shoes that are similar to its Adidas Stan Smith style. And last month, it took aim against Athletic Propulsion Labs (APL) for infringing on its Three-Stripe Mark.
